CallWaiting.ai is operated by Click Refresh Inc., a California corporation, with technology development by NGX Labs LLC.
1. SMS Messaging Consent
By providing your phone number and opting in to receive SMS messages from a business using CallWaiting.ai, you expressly consent to receive text messages from that business via the CallWaiting.ai platform. These messages may include appointment confirmations, follow-up summaries, and service-related notifications.
2. Prior Express Written Consent (PEWC)
In accordance with the Telephone Consumer Protection Act (TCPA), CallWaiting.ai requires prior express written consent before sending any marketing or promotional SMS messages. Consent is obtained through one of the following methods:
- A written opt-in form completed by the caller or customer
- A clickwrap agreement presented at the time of booking or registration
- An explicit SMS reply confirming consent (e.g., replying YES to a confirmation message)
Verbal consent during an AI-handled phone call alone does not constitute prior express written consent for marketing messages under TCPA.
3. Message Frequency
Message frequency varies by business and use case. You may receive between 1–5 messages per interaction depending on the service configuration of the business you are contacting.
4. Message and Data Rates
Standard message and data rates from your wireless carrier may apply. CallWaiting.ai does not charge separately for SMS delivery.
5. How to Opt Out
You may opt out of SMS messages at any time by replying STOP to any message. You will receive one confirmation message confirming your opt-out. No further messages will be sent unless you opt back in.
To opt back in after opting out, reply START to any message from the number, or contact the business directly.

7. Privacy
Your phone number and consent status are handled in accordance with our Privacy Policy. We do not sell or share your phone number with third parties for their own marketing purposes.
